RESOLUTION OF THE COUNCIL RENEWING AND REVISING THE MANDATE OF THE REGULATORY GOVERNANCE COMMITTEE
THE COUNCIL,
HAVING REGARD to Articles 1 and 2 of the Convention of the Organisation for Economic Co-operation and Development (OECD) of 14 December 1960;
HAVING REGARD to the Rules of Procedure of the Organisation;
HAVING REGARD to the Resolution of the Council on Partnerships in OECD Bodies [C(2012)100/REV2/FINAL];
HAVING REGARD to the decision of the Council to establish a Committee on Regulatory Policy, transforming the Working Party on Regulatory Management and Reform into a level I committee and encompassing the work previously conducted by the Group on Regulatory Policy [C(2009)36 & C(2009)36/CORR2/REV1 and C/M(2009)21/PROV, Item 240], whose mandate was last revised in 2020 [C(2020)143];
HAVING REGARD to the results of the In-depth Evaluation of the Regulatory Policy Committee [C(2022)62];
RECOGNISING that regulation is one of the key levers by which governments—at the national, international as well as regional and local levels—act to promote economic prosperity, enhance welfare and pursue the public interest and that regulations need to be well designed and implemented to achieve their goals and not unnecessarily hamper other policy goals, including economic growth;
RECOGNISING that regulatory policy is a whole-of-government responsibility that needs to be supported at a high political level to enhance the performance, efficiency and competitiveness of national economies and their ability to adapt to change;
HAVING REGARD to the proposed renewal and revision of the mandate of the Regulatory Policy Committee [C(2026)17/REV2];
DECIDES
A. The Regulatory Policy Committee (hereinafter the “Committee”) is renewed with the following revised mandate:
I. Objectives
1.Promote the development and implementation of quality regulations, in particular by providing support to ensure high-quality, evidence-informed, proportionate laws, regulations and standards that uphold transparency, legitimacy and accountability, building trust while delivering the intended outcomes for responsible and resilient prosperity.
2.Encourage regulatory practices that foster simple and streamlined regulations, in particular by supporting practices that develop and deliver regulations that are proportionate and risk-based for all actors including citizens and businesses, together with initiatives aimed at reducing existing regulatory burden and the use of the better regulation tools, such as impact assessment and evaluation.
3.Ensure that regular reviews of the existing stock of regulations take place making sure that they remain fit for purpose and achieve the objectives for which they were adopted.
4.Support adaptive, agile and resilient regulatory systems, in particular by recognising the potential of technology and encouraging innovation and adaptability in regulatory approaches and systems to ensure they enable positive technological change and respond effectively to emerging risks and societal needs.
5.Advance participatory and transparent governance of regulatory policy, with a view to ensuring that regulatory processes are participatory, transparent, and accountable, engaging stakeholders and citizens.
6.Enhance regulatory co-operation across levels of government and jurisdictions, with a view to promoting co-ordinated approaches that reduce regulatory fragmentation, address cross-border challenges, and support global policy coherence, while taking into account different national contexts.
II. Working Methods
7.To achieve its objectives, the Committee shall, in particular:
i)Promote the understanding of regulatory policy concerns and objectives to support other relevant OECD committees and stakeholders in delivering societal objectives in all relevant policy areas and sectors;
ii)Review, analyse, and anticipate the latest trends in regulatory policy and ensure that they are widely disseminated and taken on board, including by providing the appropriate fora to discuss specific issues that deserve in-depth analytical work where relevant;
iii)Produce analytical reports, guidance, and peer reviews, where appropriate, at the international, national, regional and sectoral levels, as well as develop and support the implementation of OECD and other international standards in the field of regulatory policy;
iv)Support the effective governance and performance of economic and sector regulators and other authorities including through the Network of Economic Regulators;
v)Encourage a broad range of views including through the participation of non-Members in the work of the Committee;
vi)Continue to develop measurement standards, indicators, databases, toolboxes and methodologies to support evidence-informed regulatory policy;
vii)Ensure effective communication and dissemination of the Committee’s work;
III. Co-ordination arrangements
8. To achieve its objectives, the Committee shall:
i)Maintain close working relationships with other relevant OECD bodies to ensure a crosscutting perspective to regulatory policy;
ii)Engage with relevant stakeholders, including international organisations, business, organised labour and civil society to promote transparency and relevance of the Committee’s work.
B. The mandate of the Committee shall remain in force until 30 June 2031.
